Our tactics in handling these cases really depend on where you’re at when you come to us. We can assure you that you will have a much easier time throughout your entire case if you bring a lawyer on as soon after an injury as possible, primarily because some of the most important issues that take place in an injury case usually happen within the first 1-30 days after the injury has occurred. A common pitfall is that as soon as an injury happens the person or entity responsible for the injury will fill out an injury report for their insurance provider, and/or give a recorded statement, and help prepare their insurance company for the key issues that will impact the liability of the defendant in the case. This gives the Insurance company and Insurance Defense Attorney a tremendous advantage from the very beginning. This is compounded by the fact that many injured plaintiffs will voluntarily give recorded statements to the insurance company of the Defendant, or to their own insurance company, or to the insurance company for a business entity of a location where they were injured at. These companies are not advocates for the injured party, and work from the very beginning of these situations to devalue the claim. Plaintiff, if they are able to even tell their side of the story, may say, “the guy in the car ran the stop sign, and accelerated into me!”. Who wins? Well, if no one actively goes in to secure video footage from all of the available security cameras in the area, all the footage may be destroyed. At that point, it’s entirely up to a jury on apportioning fault or comparative negligence as it’s called in Illinois. If you’re injured but found to be more at fault than the Defendant (51% to 49%), even if your injuries are traumatic and severe, you cannot recover against the Defendant for your injury at trial. So in the scenario above, if a jury hears the case and is unable to make a decision on who is more at fault than the other, you may end up with an adverse verdict where you’re unable to recover anything for your injuries you suffered.
