WHO CAN BE HELD RESPONSIBLE IF I AM HURT IN A DUI-RELATED CRASH?

If your injury was related to alcohol consumption and the DUI driver was being served alcohol at a bar immediately before the crash, Illinois has the Dram Shop Act found at (235 ILCS 5/6-21)(from Ch. 43, par. 135) which can make an establishment that serves alcohol responsible for injuries caused by one of their customers.

A plaintiff (injured party) only needs to show the following to win under the Dram Shop Act:

  • That the establishment served alcohol to the Defendant
  • That the alcohol served to the Defendant caused or materially contributed to the Defendant’s intoxication
  • The intoxication was the proximate cause of the injury

The amount available on a claim under the Dram Shop Act adjusts every year, but it DOES offer an additional avenue of recovery for someone hurt due to the intoxication of another if they were served at an establishment prior to causing the injury.   • Wrongful Death: The family of a person killed in a car crash or who later dies from injuries related to a car crash crash can pursue damages under the Illinois Wrongful Death Act.
